By placing orders for products or services from the website, you acknowledge that you have read, understood, and agree to abide by these Terms.

Purchasing Guidelines:

To buy alcohol through our platform, you must be at least 18 years old and specify a delivery address within Australia. By placing an order, you confirm that you meet this age requirement. If you're purchasing alcohol as a gift, the recipient must also be at least 18 years old. It's your responsibility to ensure that the recipients of the liquor you buy from us are of legal drinking age.

Occasionally, we may offer exclusive deals related to our products and services. Please note that we reserve the right to end any special offer at any time without prior notice. If an offer is terminated, it will still apply to products or services ordered by you in accordance with the terms and conditions before the termination date of the special offer.

Pricing Information:

All prices are listed in Australian dollars and include GST unless otherwise specified. Please note that delivery charges are not included in the listed prices unless stated otherwise.

Payment Process:

Upon completing your order, the full payment, including the product price and any applicable delivery charges, will be charged to your preferred payment method used. Delivery will only commence once the payment has been processed and validated. We accept payments via Visa and MasterCard. 

Product Descriptions:

If a product is mistakenly listed on our website with an incorrect price or description, we reserve the right to refuse or cancel any orders placed for that product at the incorrect price or based on the incorrect description, regardless of whether the order has been confirmed and your credit card has been charged. If your credit card has been charged for the purchase and the order is subsequently cancelled due to pricing or description errors, we will promptly notify you and issue a credit to your credit card account for the amount charged.

Availability of Products:

All products are available for sale subject to stock availability. If a product is out of stock, we will reach out to you to propose a substitute product of equal quality. Should you decline the substitute, and your credit card has already been charged for the out-of-stock item, we will cancel your order and promptly issue a credit to your credit card account for the charged amount.

Shipping Information:

We offer nationwide delivery through Courier Please Signature Required and strive to deliver to metropolitan areas of Australian capital cities within 5-10 working days (Monday to Friday, excluding Public Holidays).

Deliveries to regional centers and areas outside metropolitan capitals may take 7-12 working days. For remote or outlying regions, expect slightly longer delivery times. Please note that delivery times are contingent upon stock availability, and we cannot guarantee specific delivery dates.

To ensure successful delivery and tracking of your order, please provide a delivery address where you will be available to sign for receipt during regular business hours. Deliveries typically occur Monday to Friday between 9:00 am and 5:00 pm, excluding public holidays, to either a nominated business premises or residence. If you're unavailable at the time of delivery or if the carrier cannot deliver to your specified address, they will leave an "Article Awaiting" card. The goods will then be automatically redirected to the nearest Post Office, which is considered delivery to you under these Terms.

Please note that goods will not be left unattended without your explicit instructions, nor will they be delivered to individuals under 18 years old (proof of age required). It is your responsibility to contact the booked courier company within 7 days of receiving the "Article Awaiting" card.

We are not liable for goods left unattended upon your request or for goods remaining unclaimed due to failure to contact the carriers within the specified time frame. Minimum Order Requirement: There is no minimum order requirement, but delivery charges will be applied.

Delivery Locations:

We offer alcohol delivery across Australia, excluding areas designated as dry zones by the Australian Government or Australian Islands within International Waters. Undeliverable Alcohol:

If the nominated courier company deems your order undeliverable, they will notify us, prompting us to contact you to organize re-delivery in accordance with our terms.

Damaged Items:

Should you receive your order with one or more broken bottles, we will provide a credit equivalent to the amount paid for the damaged bottles or, at our discretion, send replacement bottles. To be eligible, you must notify us within 7 days of the delivery date. We may request proof of damage as a condition for issuing a refund or replacement.

Liability:

Upon delivery, the risk of damage, loss, or deterioration of products transfers to you in accordance with these Terms. You acknowledge that the risk of loss or damage to products assigned to your order transfers upon their delivery, even in cases of delivery to unattended locations where no one is present or where a person present is not acting on your behalf.

Product Guarantees:

We guarantee that products provided by us through the www.madeinportugal.com.au website will meet a standard of merchantable quality upon delivery. However, we explicitly disclaim all other express, implied, statutory, and other warranties, guarantees, and representations to the fullest extent permitted by law. In the event that applicable law prohibits the exclusion of any warranties mentioned above, our liability for any breach of such warranties, conditions, or representations, including the warranty regarding merchantable quality, is limited to our discretion to replace or provide substitute products or services, or to refund the costs of the products or services affected.

Liability Limitation:

By using our services, you agree to indemnify, defend, and hold us, along with our officers, directors, employees, agents, contractors, licensors, and suppliers, harmless from and against all losses, expenses, claims, proceedings, damages, and costs (including actual, special, direct, indirect, incidental, exemplary, or consequential) arising from any violation of these Terms, any associated terms and policies, the rights of any third party, or any applicable law, statute, ordinance, or regulation. This also includes any claims or proceedings arising from activities related to the products and services provided by us.

Force Majeure:

You acknowledge and consent that we are relieved of our supply and other obligations and will not be held accountable for any delays in instances where we are unable to fulfill our obligations under these Terms due to circumstances beyond our reasonable control. We will make every effort to inform you of any delays and their anticipated duration. If we are unable to fulfill our obligations for an extended period beyond what is considered reasonable, we reserve the right to cancel your order and provide you with a credit for the amount paid for the order, without incurring further liability to you.
